1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of dayscaferobotics.com (the “Site”), which is operated by Days Café Robotics (“Days Café,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 13 years old to use the Site. By using the Site, you represent and warrant that you meet this eligibility requirement and that you have the legal capacity to enter into these Terms.

3. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes. You may not:

• Copy, reproduce, distribute, modify, or create derivative works of any content on the Site without our prior written permission;

5. User Submissions

When you submit information through the contact form or otherwise communicate with us, you grant us a non-exclusive, royalty-free, worldwide license to use that information for the purposes of responding to and managing your inquiry and operating our business. You represent that any information you submit is accurate and that you have the right to provide it.

6. Disclaimer of Warranties

The Site and all content on the Site are provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. To the fullest extent permitted by applicable law, in no event will Days Café Robotics, its co-founders, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Site shall not exceed one hundred U.S. dollars (US$100).

8. Indemnification

You agree to defend, indemnify, and hold harmless Days Café Robotics and its co-founders, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of another party.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Days Café Robotics. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of any third-party site or service is at your own risk.

10. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You agree that any action, dispute, or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Collier County, Florida, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Material changes will be communicated by posting a prominent notice on the Site. Your continued use of the Site after such changes constitutes your acceptance of the updated Terms.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Days Café Robotics regarding your use of the Site and supersede any prior agreements between you and us regarding the same.
